Brendan J. Mooney
Mr. Mooney is an associate in the firm’s Energy and Utilities practice group. He advises clients on a variety of matters including electric and natural gas regulations, utility facility siting and operational compliance, construction disputes, as well as environmental and land use matters concerning Federal, state, and local permitting, regulatory compliance, and litigation.
Mr. Mooney’s energy practice is focused on the siting and permitting of major utility facilities through the New York State Public Service Law (“PSL”). He advises clients regarding the regulatory requirements of development and reconstruction of major utility facilities, preparation of applications for Certificate of Environmental Compatibility and Public Need, environmental permitting, local municipal laws, third party negotiations, and administrative hearings. In that regard, he works closely with clients and technical experts to fully assess the legal issues and potential permitting obstacles to ensure a successful and expedient review process.
Mr. Mooney’s environmental practice includes counseling clients on a vast array of issues including compliance and litigation matters involving the New York State Environmental Quality Review Act (“SEQRA”), New York State Mined Land Reclamation Law, state and Federal clean water laws and hazardous waste regulations, New York State Oil Spill Law, and environmental due diligence. He has successfully represented clients in matters concerning petroleum discharges, State Pollutant Discharge Elimination System (“SPDES”) permit violations, spill response cost recovery, environmental insurance coverage, bulk storage tank violations and permitting, New York State and New York City Brownfield Cleanup Program property redevelopment, SEQRA and local land use Article 78 proceedings, right-to-build issues, and rezoning and compliance with local land use regulations.
Mr. Mooney’s construction law practice includes advising clients regarding construction and design defects, construction contract disputes, and mechanics liens. He has successfully represented owners, general contractors and suppliers with regard to the enforcement and defense of mechanics liens, product/engineering defects and negligence claims, insurance coverage, arbitration issues, mediation before the American Arbitration Association, and matters litigated in New York State Supreme Court.
Prior to joining Cullen and Dykman LLP, Mr. Mooney was an associate at a Manhattan law firm, advising clients with respect to environmental, land use and construction law matters. While earning his J.D. at Hofstra University School of Law, Mr. Mooney worked at a national environmental consulting firm managing a portfolio of environmental assessment and remediation projects for Fortune 500 corporations.
