$600,000 Supplementary Under-Insured Motorist Settlement

Cullen and Dykman Partner Timothy Flanagan obtained a $600,000 settlement from his client’s Supplementary Underinsured Motorist (SUM) insurance carrier in addition to the maximum $50,000 insurance coverage available on the other vehicle involved in this two car collision. The client suffered a compression fracture at L1 and a fracture of a small bone in her left foot. She ultimately underwent a kyphoplasty on an outpatient basis on May 13, 2010, followed by physical therapy. She was out of work for six months, and her medical expenses and lost earnings were reimbursed by her No Fault carrier. Liability was not an issue, but the defendants argued that the Plaintiff's complaints were the result of preexisting conditions reflected in the medical records of the client’s treating physicians. The total settlement of $650,000 was paid for the client’s pain and suffering.
