Cullen and Dykman Obtains Defendants Verdict in Favor of Homeowner Clients

Cullen and Dykman Partner Kenneth S. Buffaloe obtained a jury verdict in favor of his homeowner clients in a personal injury action in Supreme Court, Suffolk County and tried before Judge Joseph A. Santorelli. The 48 year old plaintiff claimed that he slipped and fell on our clients’ property while delivering a package due to a dangerous accumulation of ice thereat. Plaintiff claimed to have suffered left parasagittal disc herniation at L5-S1; central disc herniations at L4-L5; circumferentially bulging disc at L4-L5; lumbago; lumbar myalgia; left lumbar radiculitis; post traumatic lumbar sprain/strain; post traumatic myospasm and myofascial; myofascial pain syndrome; post traumatic bilateral radicular lower back pain; subluxation complex syndrome at the cervical, thoracic and lumbar spines; exacerbation of pre-existing but asymptomatic degenerative changes at L4-L5 and L5-S1; left sided radiculopathy; and L4-5 and L5-S1 foraminal stenosis with left lumbar radiculopathy. As a result of his injuries, plaintiff was totally disabled from his employment. The jury rendered a unanimous verdict finding no negligence on the part of the homeowners.
