Corporate Environmental Issues
The firm provides counsel and litigation services on various environmental issues in connection with proposed transactions and ongoing business operations. The firm regularly advises clients on the requirements imposed by various federal, state and local environmental laws and their related liabilities. The firm's environmental clients include lending institutions, utilities, pipeline corporations, educational institutions and not-for-profit corporations.
Firm attorneys provide advice on a wide array of environmental matters, including SEQRA/NEPA processes, lender liability (under CERCLA, RCRA and New York Navigation Law), petroleum storage tank regulations, asbestos-related issues, "stigma" damages in property valuations, the availability of insurance coverage for environmental risks and litigation coverage disputes, and regulatory permitting requirements. In connection with these matters, our attorneys review various environmental documents, including Phase I and Phase II environmental reports and DEC Consent Orders.
